The injured child must be dependent on his or her parent for support. At the very least the child’s dependence must be a financial dependence on his or her parents, either prior to the accident or after the accident or both.

Spousal loss of consortium claims, a child’s loss of consortium claim due to the injuries of a parent or a parent’s loss of consortium due to the injuries suffered by a child are all claims involving non-economic damages. The value of these claims are to be decided by a jury or a Judge. The loss to be valued is the loss of the enjoyment of life, and the loss of that person’s companionship and support.
